UPC applauds Supreme Court’s landmark judgement

On January 31, Supreme Court of Uganda delivered a landmark ruling, barring trails of civilians in the military court martial.

The Justices, led by Chief Justice Alfonso Owiny-Dollo, ruled that continued trail of civilians is unconsitutional and has to cease.

Ugandans have since welcomed the ruling, with President Museveni on the other time “bitter with the ruling.”

On Wednesday, Uganda Peoples Congress (UPC) joined Ugandans in applauding the Supreme Court.

Muzeyi Faizo, the party’s head of media and communications said they welcome the Supreme Court judgment in Attorney General versus Hon. Michael Kabaziguruka rendered last Friday on 31st January 2025 after four years of waiting, which has settled the issue of the illegal trial of civilians in the military courts.

“The decision, though coming late, underscores a triumph of citizenship’s struggle for democracy, rule of law, good governance, accountability, constitutionalism, and protection of human rights,” Faizo said.

He added that the Supreme Court “stood its grounds” of an independent arm of government to pronounce itself on trial of civilians in military courts, which decision has restored judicial hope to Ugandans, and this hope should not be shattered by those who are overzealous.

“The party calls upon the government to release with immediate effect all those being illegally detained in prison and, more specifically, release Dr. Kiiza Besigye and Obed Lutale from the illegal detention.”

Faizo added: “Article 92 of the Constitution of the Republic of Uganda, 1995, as amended, bars Parliament from enacting laws that are contrary to the decision of the Court; we therefore implore the Attorney General of Uganda, Mr. Kiryorwa Kiwanuka, not to violate the constitutional provisions by bringing amendments to the UPDF Act that will undo the Court decision.”

UPC stated that they encourage the Executive to view the progressive Court decision as an avenue for reform and protection of human rights, rule of law and constitutionalism.
