A libel case involving the head of the Lango Cultural Institution (LCI), Eng. Michael Moses Odongo Okune vs Olobo Odur and Polycarp Omor has been on since 2021.
Before the Makindye Chief Magistrates’ Court, the complainant, Odongo, sued Odur and Omor for libel and defamation.
On April 15, it came up for a defence hearing before His Worship Geoffrey Akena. However, the complainant and his lawyer were not present in court.
The accused persons were present together with their lawyer.
The State Attorney informed the Court that following the recent ruling by the Constitutional Court of Uganda, some sections of the Computer Misuse Act including Section 25 on offensive communication were declared unconstitutional because they go against the right to freedom of expression.
Because of this decision, the State Attorney explained that the case can no longer continue since it was based on those sections of the law.
The Court was advised to set another date next month (May) to allow time to prepare a formal letter to officially close the case.
The six-year court case is now expected to come to an end once the final process is completed.
