Soroti—13, September 2021: The legal team representing the Ngora County Member of Parliament, Juliet Achayo Lodou, has asked High Court to disregard the 26 affidavits presented by the applicant’s teams.
Alfred Okello Oryem of Okello-Oryem and Company Advocates, who is representing Achayo, says out of the 40 affidavits, 26 affidavits do not pass the test of the law, therefore they should be thrown away.
Addressing the media after, Okello says all the witnesses didn’t specify whether they were males or females in their affidavits.
“The witnesses also did not attach photocopies of their national Identities to their affidavits,” he adds.
Okello further states that the witnesses also claim that they are illiterate and do not know how to read and write and yet they signed documents written in English without a certifying document from the commissioner of oath to find out their claims.
He states that once the 26 affidavits are disregarded, it will leave them with only the affidavits of the complainant, David Abala.
Abala David is represented by Medard Ssegona and Philip Opio and Company Advocates.
Philip Opio is a lawyer representing the applicant. He asked Court to grant them time to allow them to reply to the issues of contention sighted by the defence lawyers.
Lady Justice Jane Kajuga Okuo is the presiding Judge. She adjourned the Court for two hours to allow the Lawyers to prepare their response.
Court was expected to resume at 1 pm continuing with the proceedings.
